Why clear communication matters in immigration advice

Immigration decisions can shape where you live, work, study and build your family life. When so much depends on the outcome, it is reasonable to expect your adviser to explain things plainly, tell you what they can and cannot do, and keep you informed. Here is what that looks like in practice, and how to check before you hand over any details.

Immigration advice is a regulated activity

In the UK, anyone giving immigration advice must be properly authorised. GOV.UK states that the Immigration Advice Authority (IAA) is the independent regulator of immigration advisers, and that you can check whether an adviser is authorised using the IAA's free online Adviser Register. It is sensible to do this before you share personal information or pay any fees.

What clear communication looks like

The IAA's Codes of Standards (2024 edition) set out what regulated advisers are expected to do. In plain terms, you should expect:

• A clear client care letter. Before work starts, you should receive written terms explaining what the adviser will do for you and how the service will run.

• Regular updates in writing. Your adviser should keep you updated on how your case is progressing.

• Transparent, reasonable fees. Advisers who charge fees should have a fee scale, charge a reasonable fee related to the work done, and invoice you clearly.

• Honesty about scope. Advisers must not work above the level they are authorised for. If your matter needs a different level of help, you should be told.

No honest adviser can guarantee a Home Office decision. Be cautious about anyone who promises a particular outcome.

Questions worth asking any adviser

1) Are you authorised by the IAA, and at what level?

2) Can you help with my particular situation, or might it need someone else?

3) What will I receive in writing before we begin?

4) How will I be told what the fees are, and when they are due?

5) How will you keep me updated?

How we approach this at Talk Immigration

Talk Immigration Ltd is an IAA-regulated business, and our work is limited to the scope of our authorisation. You can read more on our Regulatory Information page, and our Fee Information and Complaints Procedure pages explain our fees and how to raise a concern.

Our process is deliberately simple. You complete the free initial assessment. We review it manually to check whether we can help within our authorised scope. If we can, we may invite you to a consultation. Submitting the form is an enquiry, not an automatic acceptance, and we will tell you plainly if your matter falls outside what we can do.

If you would like to begin, start your initial assessment.
